The Federal High Court in Abuja has dismissed a suit seeking a fresh investigation into the death of singer Ilerioluwa Aloba, popularly known as Mohbad. Justice James Omotosho delivered the judgment on Thursday. The case involved the Registered Trustees of Break the Silence Foundation and the Nigeria Police Force.
The foundation asked the court to order the police to conduct a new investigation. However, Justice Omotosho ruled that the foundation lacked the legal capacity to file the case. The judge also described the application as speculative and lacking sufficient merit.
Furthermore, the court noted that the foundation failed to present the original police investigation report. According to the judge, the report could have supported the foundation’s claim that the earlier investigation was inadequate. Without that document, the court found the argument unconvincing.
Justice Omotosho also warned lawyers involved in ongoing cases. He cautioned them against discussing matters before the court in media interviews or on social media. The judge said such conduct amounts to professional misconduct.
Mohbad died in Lagos in September 2023 at age 27. His death sparked widespread public interest and calls for answers.
